Terms of Service for Cheatless Rust

1. Definitions

"Cheatless Rust," "we," "us," and "our" refer to PYRRHIC, LLC, a Michigan Limited Liability Company, which owns and operates the Cheatless Rust Services.

"Services" refers to the Cheatless Rust game servers, website, and any related services or content provided by PYRRHIC, LLC.

2. Acceptance of Terms

If you disagree with any part of these Terms, you are prohibited from accessing or using the Services.

3. Modifications to Terms

3.1. Cheatless Rust reserves the right, at its sole discretion, to modify or replace these Terms at any time. Any changes to the Terms will be effective immediately upon posting.

3.2. Notification of Changes: We will notify users of any changes to these Terms in the following ways:

• By updating the "Last Updated" date at the top of this Terms of Service page
• By posting a notice in the Announcements channel of our community Discord server

3.3. Our community Discord server is accessible to all users and can be joined through the link provided on our website's /join-us page. We strongly encourage all users to join this server to stay informed about important updates and changes to our Terms of Service.

3.4. You may check this Terms of Service page and our Discord Announcements channel at any time without this action alone constituting acceptance of any changes.

3.5. However, by using our Services (including, but not limited to, accessing our game servers or participating in gameplay), you agree to be bound by the version of these Terms in effect at the time of such use.

3.6. If you do not agree with the current Terms, you must not use our Services. Your only recourse is to stop using the Services.

3.7. We encourage you to review these Terms regularly as your continued use of the Services after changes to the Terms will constitute your acceptance of those changes.

4. Eligibility and User Responsibility

4.1. Age Restriction: You must be at least 16 years old to use the Services.

4.2. Account Responsibility: You are solely responsible for maintaining the security of your Steam and Discord accounts that you use to access our Services. You agree to accept responsibility for all activities that occur under your Steam ID and Discord ID in connection with our Services.

4.3. Prohibited Activities: You expressly agree not to engage in any form of cheating, hacking, exploitation of glitches, or any other activities that provide an unfair advantage or disrupt the integrity of the game.

4.4. Steam and Discord Terms: You acknowledge that your use of Steam and Discord to access our Services is also subject to the respective terms of service of those platforms. Any violation of Steam or Discord's terms may also be considered a violation of these Terms.

5. Anti-Cheating Measures

5.1. Cheatless Rust employs various anti-cheating measures, including but not limited to software detection, player reporting systems, and administrator spectating.

5.2. By using our Services, you explicitly consent to these anti-cheating measures and acknowledge that they may involve monitoring and analysis of your gameplay and system data.

6. Enforcement and Penalties

6.1. Cheatless Rust, at its sole discretion, reserves the right to suspend, terminate, or ban any user's access to the Services at any time, for any reason or no reason, with or without prior notice.

6.2. Without limiting the generality of the foregoing, Cheatless Rust will exercise this right particularly in cases where a user is found to be, or is reasonably suspected of:

• Cheating or using any form of exploit or hack;
• Knowingly teaming with or assisting cheaters;
• Engaging in any activity that disrupts the integrity of the game or negatively impacts other users' experiences outside of the scope of the game;
• Violating these Terms of Service or any other rules or guidelines set forth by Cheatless Rust;
• Engaging in any behavior deemed inappropriate or harmful to the Cheatless Rust community.

6.3. The decision to suspend, terminate, or ban a user is final and at the complete discretion of Cheatless Rust. We are not obligated to provide reasons for our decisions, though we may choose to do so at our discretion.

6.4. In addition to account suspension or termination, Cheatless Rust reserves the right to pursue all legal and equitable remedies for violations of these Terms, which may include, but are not limited to:

• Seeking monetary damages for losses resulting from the violation;
• Injunctive or other equitable relief;
• Recovery of attorney's fees and legal costs associated with enforcing these Terms.

6.5. You agree that cheating, assisting cheaters, and other violations of these Terms cause damage to Cheatless Rust, including harm to its reputation, community, and the integrity of its Services. You acknowledge that these damages may be significant and can exceed the value of any in-game purchases or subscriptions.

6.6. Banned users may appeal their ban by emailing admin@cheatlessrust.com with relevant information. However, Cheatless Rust reserves the right to deny any appeal at its sole discretion, and is not obligated to respond to or consider any appeal.

7. User Conduct

You agree to use the Services in full compliance with all applicable laws in the United States, Canada, and your jurisdiction. Any violation of applicable laws or regulations in connection with your use of the Services is strictly prohibited.

8. Donations and Recognition

8.1. Cheatless Rust may, at its discretion, recognize users who donate to support our Services. We greatly appreciate the support of our community in helping us maintain and improve our Services.

8.2. While we're grateful for every donation, please note that donations are voluntary contributions to support our Services and are not purchases. As such, they are typically non-refundable. We encourage users to carefully consider their decision before making a donation.

8.3. If you have any questions or concerns about a donation you've made, please contact us at admin@cheatlessrust.com. While we cannot guarantee refunds, we will review each situation on a case-by-case basis and strive to address any issues to the best of our ability.

9. Intellectual Property Rights

9.1. The Services, including but not limited to its original content, features, and functionality, are owned by Cheatless Rust and are protected by applicable intellectual property and proprietary rights laws.

9.2. The Cheatless Rust name, logo, and any other trademarks, service marks, or logos used by Cheatless Rust are the property of Cheatless Rust.

9.3. Users may not use, copy, reproduce, modify, publish, transmit, distribute, perform, display, or sell any of Cheatless Rust's proprietary information without express written permission from Cheatless Rust.

9.4. Any feedback, comments, or suggestions you may provide regarding the Services is entirely voluntary, and we will be free to use such feedback, comments, or suggestions as we see fit without any obligation to you.

10. Termination

Cheatless Rust may terminate or suspend your account and bar access to the Services immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of these Terms.

11. Limitation of Liability

11.1. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL CHEATLESS RUST, ITS OWNERS, DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES, BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

1. YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICES;
2. ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICES, INCLUDING WITHOUT LIMITATION, ANY DEFAMATORY, OFFENSIVE OR ILLEGAL CONDUCT OF OTHER USERS OR THIRD PARTIES;
3. ANY CONTENT OBTAINED FROM THE SERVICES;
4. UNAUTHORIZED ACCESS, USE OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT;
5. ANY BUGS, VIRUSES, TROJAN HORSES, OR THE LIKE THAT MAY BE TRANSMITTED TO OR THROUGH OUR SERVICES BY ANY THIRD PARTY;
6. ANY ERRORS OR OMISSIONS IN ANY CONTENT OR FOR ANY LOSS OR DAMAGE INCURRED AS A RESULT OF THE USE OF ANY CONTENT POSTED, TRANSMITTED, OR OTHERWISE MADE AVAILABLE THROUGH THE SERVICES;
7. THE OUTCOME OF ANY ACTION TAKEN AGAINST USERS SUSPECTED OF CHEATING OR VIOLATING THESE TERMS;
8. ANY INTERRUPTION OR CESSATION OF TRANSMISSION TO OR FROM THE SERVICES;

WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), PRODUCT LIABILITY OR ANY OTHER LEGAL THEORY, WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE, AND EVEN IF A REMEDY SET FORTH HEREIN IS FOUND TO HAVE FAILED OF ITS ESSENTIAL PURPOSE.

11.2. THE FOREGOING LIMITATION OF LIABILITY SHALL APPLY TO THE FULLEST EXTENT PERMITTED BY LAW IN THE APPLICABLE JURISDICTION. YOU SPECIFICALLY ACKNOWLEDGE THAT CHEATLESS RUST SHALL NOT BE LIABLE FOR USER SUBMISSIONS OR THE DEFAMATORY, OFFENSIVE, OR ILLEGAL CONDUCT OF ANY THIRD PARTY AND THAT THE RISK OF HARM OR DAMAGE FROM THE FOREGOING RESTS ENTIRELY WITH YOU.

11.3. YOU AGREE THAT ANY CAUSE OF ACTION ARISING OUT OF OR RELATED TO THE SERVICES MUST COMMENCE WITHIN ONE (1) YEAR AFTER THE CAUSE OF ACTION ACCRUES. OTHERWISE, SUCH CAUSE OF ACTION IS PERMANENTLY BARRED.

12. Disclaimer

Your use of the Services is at your sole risk. The Services are provided on an "AS IS" and "AS AVAILABLE" basis. The Services are provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement or course of performance. Cheatless Rust, its subsidiaries, affiliates, and licensors do not warrant that a) the Services will function uninterrupted, secure or available at any particular time or location; b) any errors or defects will be corrected; c) the Services are free of viruses or other harmful components; or d) the results of using the Services will meet your requirements.

13. Data Security and Privacy

13.1. Cheatless Rust implements extensive and robust security measures to protect your personal information, including but not limited to:

• Utilizing state-of-the-art encryption methods, including PGP encryption for sensitive data
• Employing an air-gapped computer system for storing critical information, isolated from external networks
• Implementing stringent access controls and security protocols

13.2. Despite these extraordinary efforts, it is important to understand that no method of electronic storage or transmission over the internet is 100% secure. While we strive to use commercially acceptable and, in many cases, above-industry-standard means to protect your personal information, we cannot guarantee its absolute security.

13.3. You acknowledge and accept that there are inherent risks in transmitting and storing data electronically, including but not limited to:

• Potential breakthroughs in encryption technology that may compromise currently secure methods
• Unforeseen vulnerabilities in software or hardware
• Sophisticated cyber attacks or physical security breaches
• Acts of nature, war, terrorism, or other events beyond our control that may affect our physical or digital infrastructure

13.4. By using our Services, you acknowledge these risks and agree that Cheatless Rust shall not be held liable for any unintentional loss, misuse, or alteration of data, to the fullest extent permitted by law, despite our best efforts to prevent such occurrences.

13.5. We are committed to transparency in our data handling practices. For more detailed information, including what data we collect and how we use it, please refer to our Privacy Policy. We encourage you to review this policy regularly, as it may be updated from time to time to reflect changes in our practices or for other operational, legal, or regulatory reasons.

14. Governing Law and Jurisdiction

14.1. These Terms and your use of the Services shall be governed by and construed in accordance with the laws of the State of Michigan and the United States of America, without regard to its conflict of law provisions.

14.2. You agree that any legal action or proceeding between you and Cheatless Rust shall be brought in state or federal courts located within Michigan, United States. Both you and Cheatless Rust consent to the personal jurisdiction and venue of these courts.

14.3. Notwithstanding the above, Cheatless Rust reserves the right to bring any suit, action, or proceeding against you for breach of these Terms in your country of residence or any other relevant country. You waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts.

14.4. If you are accessing the Services from outside the United States, you do so at your own risk and are responsible for compliance with the laws of your jurisdiction.

15. Dispute Resolution

Any dispute arising from or relating to the subject matter of this Agreement shall be finally settled by arbitration in Michigan, United States, using the English language in accordance with the Arbitration Rules and Procedures of JAMS then in effect, by one commercial arbitrator with substantial experience in resolving intellectual property and commercial contract disputes, who shall be selected from the appropriate list of JAMS arbitrators in accordance with such Rules. The arbitrator's award shall be final and binding and may be entered as a judgment in any court of competent jurisdiction. To the fullest extent permitted by applicable law, no arbitration under these Terms shall be joined to an arbitration involving any other party subject to these Terms, whether through class arbitration proceedings or otherwise. Notwithstanding the foregoing, we shall have the right to seek injunctive or other equitable relief in state or federal court located to enforce these Terms or prevent an infringement of a third party's rights.

16. Severability

In the event that any provision of these Terms is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms. Such determination shall not affect the validity and enforceability of any other remaining provisions.

17. Entire Agreement

These Terms constitute the entire agreement between you and Cheatless Rust regarding your use of the Services and supersede all prior and contemporaneous written or oral agreements between you and Cheatless Rust.
